A development completion bond or other similar performance guarantee in favor of the City of Athens may be required by the service-safety director to ensure compliance with the plan and stated conditions of approval. Site plan approval issued under this section shall lapse within two years unless a state issued certificate of occupancy has been issued. When a site plan becomes the subject of litigation, this two-year time limit shall be tolled until the action of a court determining the merits of the legal action has become final and the time limit for appeal has expired with no notice of appeal being taken.
