§ 5.02.08. Terms of licenses.

  • (A)

    The maximum number of commercial hauler licenses available within the City of Athens shall be four and shall be reduced with any nonrenewal or merging of licensed commercial haulers.

    (B)

    Licenses for the collection, transportation, and disposition of solid waste shall renew automatically each year for a period of three years. Renewal of the license is signaled annually by the licensed hauler's submission of fees for the next license year by June 15. Failure to submit required annual fees as stipulated above or failure to submit an annual report, referenced below, shall signal the forfeiture of the license for the remainder of the licensing period. The application for the license and the payment of fees for 2011 must be completed by July 1, 2011. Effective July 1, 2011, the annual fee for such license shall be $5,000.00 plus $25.00 for each cubic yard of total packer capacity, and the variable cost will increase annually at a rate of eight percent (for each cubic yard) over the three-year period. License shall be subject to revocation by the city upon failure of a licensed hauler to comply with the provisions of the ordinance and with reasonable regulations of the service-safety director or any governmental agency having jurisdiction in the matter.

    (C)

    The licensed hauler shall agree to perform the obligations incurred by this license in accordance with the terms of this section.

    (D)

    It shall be the responsibility of the licensed hauler to see that the hauler's collections are conducted in a neat, workmanlike manner whereby no solid waste is spilled in yards or on streets as a result of collection operations.

    (E)

    In residential areas, unless otherwise permitted by the service-safety director, collection of solid waste shall not commence before 6:00 a.m. and shall be completed by 7:00 p.m. on any single day of collection.

    (F)

    The service-safety director shall have the authority, with the advice and consent of city council, to approve or disapprove the first time issuance or transfer of said license after consideration of the reputability of the proposed new licensee. Such consent does not release the licensed hauler from any obligations and/or liabilities under the license. Violation of this specification shall result in immediate forfeiture. The transfer of a vacant license or the retirement of a licensed hauler must follow this process. Licenses can not be sold or transferred by the licensed hauler.

    (G)

    A local office or a published local telephone number shall be established by all licensed haulers. This office and the telephone number shall be listed with the city code enforcement office.

    (H)

    In order to provide service to the entire community, commercial accounts unable to find service will be assigned to a licensed hauler by the service-safety director.

    (I)

    In the spirit of shared responsibilities, the service-safety director will secure the assistance of the licensed hauler during spring cleanup and for Christmas tree and other special pickups. The licensed hauler will be given a section of the city to do cleanup in and will be responsible for all charges associated with the cleanup.

    (J)

    The licensed hauler must submit a list of the Ohio licenses for all trucks used in the city.

    (K)

    Effective January 1, 2003, no licensed hauler may contract for services beyond the expiration of the then-current license except where both hauler and customer are released upon expiration of the hauler's license.

    (L)

    Effective July 1, 2011, the licensed hauler shall implement collection of cardboard and aluminum recyclables and shall report collected amounts to the service-safety director as part of the annual report referenced below. If necessary, the service-safety director may include additional recyclable materials to the collection responsibilities of the licensed hauler.

    (M)

    Effective June 1, 2012, in each year of the license period, the license holder must submit an annual report to the service-safety director to include the following:

    (1)

    Changes in equipment;

    (2)

    Total volume of garbage (tons); landfill destination;

    (3)

    Total recycling collection;

    (4)

    Tons of cardboard collected; destination of the material;

    (5)

    Pounds of aluminum collected; destination of material; and

    (6)

    Other materials as added by the service-safety director.

    The annual report shall also include the following for each account serviced by the licensed hauler:

    (1)

    Name;

    (2)

    Address;

    (3)

    Service method; dumpster size and frequency of tipping;

    (4)

    Amount charged monthly; and

    (5)

    Current recycling effort and procedures.
