§ 49.03.01. Special right-of-way permit application.

  • (A)

    Applications for an initial special right-of-way permit shall be filed with council in such form and in such manner as dictated by the service-safety director or his/her designee. Any renewal thereof shall be filed with the service-safety director or his/her designee in such form and in such manner as dictated by the service-safety director or his/her designee.

    (B)

    Persons holding a revocable license issued by the city prior to the effective date of this chapter shall be automatically converted to holding a special right-of-way permit upon the effective date of this chapter. By the date that the person's previous revocable license is due for renewal, the person shall file a special right-of-way permit application and special right-of-way permit application fee in accordance with Section 49.03.01(C) of the Code with the service-safety director or his/her designee.

    (C)

    Applications for all special right-of-way permits require a fee of $50.00 due to the city at the time that an application for a special right-of-way permit is submitted to the city.

    (D)

    Council or the service-safety director or his/her designee, as required by this Section 49.03.01, shall, within 60 calendar days of receipt for public utilities and 120 calendar days for all other uses of a completed special right-of-way permit application, grant, deny or renew such special right-of-way permit and serve notice of such grant, denial, or renewal to the applicant by mail. A special right-of-way permit shall be granted upon a determination by council or the service-safety director or his/her designee as required that:

    (1)

    The granting of the special right-of-way permit will contribute to the public health, safety, or welfare in the city;

    (2)

    The special right-of-way permit applicant is not delinquent on any taxes or other obligations to the city and has the requisite financial, managerial, and technical ability to fulfill all its obligations hereunder.

    (E)

    The term of a special right-of-way permit shall be seven years from the date of issuance, or such term as requested by the special right-of-way permit applicant and approved by council or the service-safety director or his/her designee, as required by this Section 49.03.01.
