§ 41.03. Specific exemptions from site plan review.

  • The provisions of this Chapter shall not apply to:

    (A)

    The construction, enlargement, exterior alteration, of any single-family or two-family residential dwelling;

    (B)

    Home occupations;

    (C)

    One- and two-family residential dwelling accessory buildings;

    (D)

    The construction of a nonresidential building with less than 5,000 square feet of gross floor area;

    (E)

    The expansion, exterior alteration, or change of use of an existing nonresidential building which involves:

    (1)

    A gross floor space increase of less than 25 percent of the existing gross floor area; or

    (2)

    A property which is not within, and does not abut a single-family residential zoning district (R-1); or

    (3)

    The addition of less than five required parking spaces.

    (F)

    Nonresidential accessory buildings, less than 1,000 square feet of gross floor area;

    (G)

    Planned unit developments which are reviewed under ACC Title 21; and

    (H)

    Applications for conditional and special uses.
