§ 5.02.20. Garbage franchise terms.

  • The exclusive franchise agreement shall adhere to the following provisions, conditions, and specifications:

    (A)

    The district is defined as the area bounded by College Street to East State Street, Carpenter Street to Congress Street, President Street to Court Street, and Union Street to College Street, excluding Ohio University, by a map referenced in Ordinance 0-79-86.

    (B)

    The service provided by the hauler shall consist of no less than one daily pickup including Sundays. Sunday pickup shall be for litter baskets and restaurants only. The pickups shall be completed before 11:00 a.m. Hauler shall provide, at no charge, up to five special occasion pickups as selected by the service-safety director.

    In this area, customer accounts, whether residential or commercial, excluding Ohio University, will be serviced by the hauler.

    (C)

    The hauler shall collect garbage and rubbish of the municipality. The garbage and rubbish of the City of Athens, Ohio shall be collected by the hauler at the following locations:

    (1)

    Athens City Hall and Law Administration Building;

    (2)

    Athens parking garage; and

    (3)

    City litter baskets.

    (D)

    Collection procedures are as follows:

    (1)

    All garbage and rubbish shall be placed in centralized collection containers.

    (2)

    The service-safety director is authorized to enter into agreements with property owners to host solid waste management containers for use by franchise customers. Said agreement will permit the city's contracted hauler to maintain the services. Customers residing in the franchise area are prohibited from depositing garbage and recycling at curbside or in the city litter baskets.

    (E)

    Collection of fees:

    (1)

    The charges for residential and commercial services are established by separate ordinance.
