§ 5.02.11. Uncollected rubbish and refuse a nuisance.

  • Putrefying or malodorous solid waste if dumped in the open is declared a nuisance. Solid waste items stored in receptacles or containers or in piles on the premises in possession of the party responsible therefore for a period exceeding seven days is declared a nuisance. The person responsible for either or both types of nuisance shall be subject to a fine in accordance with Athens City Code Section 29.12.02. Citations for violations of this section may be issued by code enforcement officers, police officers, meter attendants, sanitarian, litter control officer, and others assigned by the service-safety director.

    In the event that the licensed hauler shall breach any of the material provisions of this ordinance and shall fail to remedy the same within a reasonable time after written notice from the appropriate city official to do so, or in the event of repeated breaches of minor matters, such as debris falling from trucks, missing customers or similar daily activities, leading to repeated complaints by the city, the city shall have the right to revoke the hauler's license.
