§ 49.06.02. Revocation procedures.

  • (A)

    The occurrence of any of the following situations constitutes grounds for revocation of a certificate of registration:

    (1)

    Violation of any provision of this title or any law, ordinance, rule or regulation of the city and failure to cure; or

    (2)

    Attempt to evade any provision of the issuance of a certificate of registration or the acceptance of it, including failure to comply with the indemnification requirements of this chapter; or

    (3)

    Practice any fraud or deceit upon the city; or

    (4)

    If provider files a voluntary petition in bankruptcy, is adjudicated insolvent, or files any petition or fails to contest any petition filed against it seeking any reorganization, arrangement, composition, liquidation, dissolution or similar relief;

    (5)

    Failure by a provider to provide those services represented in its application;

    (6)

    Failure following notice to procure insurance coverage as required herein.

    (B)

    If the service-safety director believes that an asserted default qualifies as any of the aforesaid conditions, the service-safety director shall serve a provider with a written notice of the reason or cause for proposed termination of the certificate of registration and shall allow a provider a minimum of ten calendar days to cure. If the provider fails to cure within ten calendar days, the service-safety director may declare the certificate of registration terminated. The determination of the service-safety director shall be final. In such instance, the service-safety director may declare the certificate of registration to be revoked and may order provider to (a) commence the removal of the facilities immediately; and/or (b) cooperate with the office of the service-safety director, or any other such agency or person authorized or directed by the office of the service-safety director to operate the facilities for a reasonable temporary period, in maintaining the continuity of service subject to this title.

    (C)

    If a certificate of registration is terminated the city may, in its sole discretion, restrict future certificates of registration from being issued to the provider.
