§ 13.07.09. Persons on roofs.

  • (A)

    No person shall occupy a roof or porch roof of any structure when police officers are citing or have cited the occupants for a violation of a city noise, disorderly conduct, or nuisance party ordinance, or a disturbance is taking place and police have ordered persons to leave the roof or porch roof.

    (B)

    A violation of subsection (A) is useable for determining a nuisance party violation.

    (C)

    Whoever violates this section is guilty of a minor misdemeanor. If the offender persists in violating this section after reasonable warning or request to desist, the offense is a misdemeanor of the fourth degree.
